Terms of Service

1. Definitions

1.1 "User"

"User" means any person or entity who accesses, views, submits, or interacts with BazaarStreet’s services. A User may be either:

• Consumer User — an individual browsing or discovering information on BazaarStreet.
• Business User — a business, service provider, organization, or representative submitting information, promotions, menus, events, flyers, or other content to BazaarStreet.

1.2 "Submitted Content"

"Submitted Content" means any information or media voluntarily submitted by a User to BazaarStreet, including but not limited to:

• Images
• Flyers
• Videos
• Documents
• Text or messages
• Audio clips
• Promotional material
• Service menus
• Event information
• URLs and digital assets
• Any content sent via WhatsApp or the website

1.3 "Platform"

"Platform" means all BazaarStreet services, including our website, WhatsApp number, admin tools, APIs, webhooks, and any digital services we operate.

2. Acceptance of Terms

By using the Platform, you agree to these Terms, whether you are using BazaarStreet as a Consumer User or Business User.

If you do not agree, please discontinue use of the Platform.

3. Compliance with WhatsApp & Meta Policies

If you interact with BazaarStreet via WhatsApp, you also agree to the WhatsApp Terms of Service, WhatsApp Business Messaging Policy, and the Meta Platform Terms and Developer Policies. Violations of WhatsApp or Meta policies may result in blocked access to our services.

4. Description of Service

BazaarStreet provides the following services:

• A curated platform for discovering local events, deals, services, businesses, and community-relevant information
• Tools for Users (including Businesses) to voluntarily submit Submitted Content via WhatsApp or the website
• Automated and semi-automated processing of Submitted Content using internal systems and AI
• Public display of event listings, promotions, menus, business information, and other extracted or approved data
• Optional tools for Businesses to promote offerings or manage information about their services
• Optional features for Users to authenticate or receive messages via WhatsApp with their consent

BazaarStreet may modify, suspend, or discontinue features at any time.

5. User-Submitted Content

5.1 Voluntary Submission & License Granted

By submitting any Submitted Content to BazaarStreet, you grant us a non-exclusive, royalty-free, worldwide license to:

• Store and process the content
• Use internal tools and AI models to extract information
• Transform, resize, classify, or format content
• Display content publicly on BazaarStreet
• Use the content to improve accuracy, usability, and search
• Derive structured data, events, promotions, or listings from Submitted Content

You represent that you have the necessary rights or permissions to submit the content.

5.2 Restrictions on Submissions

Users must not submit:

• Illegal or prohibited content
• Hateful, abusive, harassing, or violent material
• Copyrighted or third-party material they do not own or have rights to
• Spam, mass messaging, or irrelevant content
• Malware or harmful links
• Content violating WhatsApp Business Policies or Meta Commerce Policies (for example, tobacco, gambling, adult content, alcohol sales, weapons)

We may remove or refuse content at our discretion.

6. Use of WhatsApp & Messaging

By messaging BazaarStreet:

• We receive only the content you voluntarily send.
• We will not contact you unless you provide explicit consent or initiate contact.
• Your messages and media may be stored securely.
• Your personal phone number is never published publicly.
• You may request removal of your Submitted Content at any time.
• You may reply "STOP" to opt out of future communication.
• Messaging data may be shared with Meta Platforms, Inc. to deliver and process WhatsApp messages as required by their infrastructure.

7. AI Processing and Automation

BazaarStreet uses AI systems to:

• Extract text from images
• Identify events, promotions, and announcements
• Structure menus, schedules, or service information
• Generate listings or summaries
• Improve search and categorization

AI may make mistakes. Users may request corrections or removals.

8. Content Publication

Submitted Content may be:

• Displayed publicly on the Platform
• Shown in feeds, categories, search results, newsletters, or alerts
• Lightly edited (cropped, resized, color-corrected) for readability
• Augmented with metadata extracted through AI

Users may request removal of their content via WhatsApp or email: privacy@bazaarstreet.com.

We never publish the sender’s phone number or private identity.

9. Business User Responsibilities

Business Users submitting information (flyers, menus, promotions, service info) represent that:

• All information is accurate to the best of their knowledge
• They have permission to promote the listed services or events
• They comply with all applicable laws and industry regulations
• They hold BazaarStreet harmless for consumer interactions or outcomes

BazaarStreet does not guarantee traffic, customers, sales, or performance.

10. No Guarantees or Endorsements

BazaarStreet does not guarantee:

• The accuracy or completeness of AI-extracted data
• The legitimacy or reliability of User-submitted promotions or events
• Availability or quality of services listed by Businesses
• That businesses will honor discounts, prices, or promotions

Users rely on Platform information at their own risk.

11. Limitation of Liability

To the maximum extent allowed by law, BazaarStreet is not liable for:

• Errors or omissions in AI-generated or user-submitted content
• Losses or damages resulting from listed events, services, or promotions
• Business outcomes or consumer decisions
• Service interruptions, outages, or technical failures
• Unauthorized access or misuse of Submitted Content

Your use of the Platform is at your own risk.

12. Indemnification

You agree to indemnify and hold harmless BazaarStreet, its owners, and partners from:

• Claims arising from Submitted Content
• Copyright or IP disputes
• Violations of these Terms
• Misuse of the Platform
• Violations of WhatsApp, Meta, or local laws

13. Intellectual Property

All original Platform content (designs, code, branding, extraction models, UI/UX, database structures) belong to BazaarStreet.

Users may not copy, scrape, or reproduce BazaarStreet without written permission.

14. Content Removal

We may remove any Submitted Content that:

• Violates these Terms
• Violates Meta/WhatsApp policies
• Appears misleading, harmful, or offensive
• Contains copyrighted material without authorization
• Is irrelevant, spammy, or low-quality

We may block or restrict abusive Users at our discretion.

15. Changes to These Terms

We may update these Terms periodically. The "Last updated" date reflects the current version. Continued use indicates acceptance of any updates.

16. Governing Law

These Terms are governed by the laws of the State of Texas, USA.
